Schengen Overstay: Penalties and What Happens Next

Overstaying your permitted 90 days in the Schengen Area carries serious legal consequences. Learn how border guards identify overstays and how to protect yourself using our schengen visa calculator.

The 4 Major Consequences of Overstaying

1. Administrative Fines

Fines for overstaying vary widely depending on the country of departure. In Germany and Switzerland, penalties often start at €250 to €1,000+. In Greece and Italy, fines can exceed €500 for minor overstays and climb to several thousand euros for prolonged violations.

2. Schengen Entry Bans (1 to 5 Years)

Serious overstays typically result in an official entry ban recorded in the Schengen Information System (SIS II). An SIS II alert prevents you from re-entering any of the 29 Schengen member states for the entire ban duration.

3. Automated EES Biometric Flags

With the introduction of the digital Entry/Exit System (EES), passport stamps are replaced by biometric scans. Any overstay is detected automatically to the minute upon exit, triggering an immediate electronic alert for border police.

4. Rejection of Future Visas & ETIAS

An overstay history is permanently recorded across European databases. Future Schengen visa applications, national residence permit requests, and upcoming ETIAS travel authorisations are frequently rejected following an overstay violation.

What to Do If You Overstay Due to an Emergency

If you are unable to leave the Schengen Area before your 90 days expire due to force majeure (such as severe medical hospitalization, flight cancellations due to natural disasters, or humanitarian emergencies), you must apply immediately for a visa extension at the local prefecture or immigration office of the country you are currently located in.

Under Article 33 of the EU Visa Code, visa extensions for force majeure or humanitarian reasons are legally permissible if supported by valid documentary evidence. Do not simply wait until you reach border control at the airport.
